1. Accettazione dei Termini

Utilizzando Plumber AI ("Servizio"), accetti di essere vincolato dai presenti Termini di Servizio. Se non accetti questi termini, non utilizzare il Servizio.

Il Servizio è fornito da Tommaso Magnani, con sede in via Calvi 9, Castel San Giovanni, Piacenza, email: plumberaiapp@gmail.com .

2. Descrizione del Servizio

Plumber AI è un'applicazione web che fornisce:

Assistenza AI per la diagnostica di problemi con caldaie e termostati
Guide passo-passo per la risoluzione di problemi comuni
Informazioni tecniche basate sui libretti di istruzioni dei dispositivi
Database di codici errore per vari modelli di caldaie

3. Account Utente

3.1 Registrazione

Per utilizzare alcune funzionalità del Servizio è necessario creare un account fornendo un indirizzo email valido e una password.

3.2 Responsabilità dell'Account

Sei responsabile di:

Mantenere la riservatezza delle tue credenziali di accesso
Tutte le attività che si verificano sotto il tuo account
Informarci immediatamente di qualsiasi uso non autorizzato

4. Sistema Crediti e Pagamenti

4.1 Crediti

Il Servizio utilizza un sistema a crediti:

Ogni messaggio inviato all'assistente AI consuma 1 credito
I nuovi utenti ricevono crediti gratuiti alla registrazione
Crediti aggiuntivi possono essere acquistati tramite il Servizio

4.2 Acquisti

I pagamenti sono elaborati in modo sicuro tramite Stripe
I prezzi sono indicati in Euro (EUR) e includono l'IVA ove applicabile
I crediti acquistati non hanno scadenza
I crediti non sono trasferibili tra account diversi
Le condizioni di rimborso sono dettagliate nella sezione 4.3

4.3 Politica di Rimborso

La nostra politica di rimborso è conforme all'art. 16 lett. m) del D.Lgs. 21/2014 (recepimento della Direttiva UE 2011/83/UE sui diritti dei consumatori).

Crediti non utilizzati — Puoi richiedere il rimborso integrale entro 14 giorni dall'acquisto, a condizione che nessuno dei crediti acquistati nella transazione sia stato utilizzato. Invia la richiesta a plumberaiapp@gmail.com indicando l'email dell'account e la data dell'acquisto. Il rimborso viene processato entro 7 giorni lavorativi sullo stesso metodo di pagamento.

Crediti utilizzati — Una volta consumati anche solo parzialmente, i crediti non sono rimborsabili. Acquistando il pacchetto e iniziandone l'utilizzo, riconosci espressamente di rinunciare al diritto di recesso, come previsto dalla normativa europea sui contenuti digitali consumati.

Errori tecnici — In caso di doppio addebito, malfunzionamento del sistema o accredito errato dei crediti, il rimborso è automatico e prioritario. Contattaci immediatamente fornendo la ricevuta Stripe.

Contestazioni bancarie (chargeback) — Le contestazioni infondate ricevute tramite circuiti bancari verranno difese fornendo a Stripe le prove di utilizzo del servizio (log accessi, crediti consumati, indirizzo IP). In caso di esito non favorevole all'utente, il sistema scalerà automaticamente i crediti corrispondenti dall'account.

Eccezioni di buona volontà — Ci riserviamo la facoltà di concedere rimborsi parziali o totali al di fuori dei casi sopra previsti, a nostra discrezione, in particolare per nuovi utenti insoddisfatti del servizio entro le prime 48 ore dalla registrazione.

5. Utilizzo Accettabile

Ti impegni a NON:

Utilizzare il Servizio per scopi illegali o non autorizzati
Tentare di aggirare le misure di sicurezza del Servizio
Interferire con il funzionamento del Servizio
Utilizzare sistemi automatizzati (bot) per accedere al Servizio
Rivendere o redistribuire l'accesso al Servizio
Fornire informazioni false durante la registrazione

6. Limitazioni di Responsabilità

6.1 Natura Informativa

Il Servizio fornisce informazioni a scopo puramente indicativo e orientativo. Le risposte dell'assistente AI:

NON costituiscono consulenza tecnica professionale
NON sostituiscono l'intervento di un tecnico abilitato
Potrebbero contenere errori o imprecisioni
Si basano su informazioni generali che potrebbero non applicarsi al tuo caso specifico

6.2 Sicurezza

Per interventi che coinvolgono:

Impianti a gas: è OBBLIGATORIO rivolgersi a tecnici abilitati (DM 37/08)
Impianti elettrici: affidati a personale qualificato
Pressione dell'acqua: in caso di dubbi, contatta un professionista

6.3 Esclusione di Responsabilità

Il Servizio è fornito "COSI' COM'E'" senza garanzie di alcun tipo. Non siamo responsabili per:

Danni diretti o indiretti derivanti dall'uso del Servizio
Danni a persone o cose causati da interventi effettuati basandosi sulle informazioni fornite
Interruzioni del servizio o perdita di dati
Inesattezze nelle informazioni fornite dall'assistente AI

7. Proprietà Intellettuale

Tutti i contenuti del Servizio, inclusi testi, grafica, loghi, icone e software, sono di proprietà di Plumber AI o dei rispettivi licenzianti e sono protetti dalle leggi sul diritto d'autore.

Le informazioni tecniche sui dispositivi sono tratte dai libretti di istruzioni dei rispettivi produttori, utilizzate a scopo informativo.

8. Sospensione e Terminazione

Ci riserviamo il diritto di sospendere o terminare il tuo accesso al Servizio in caso di:

Violazione dei presenti Termini
Comportamento fraudolento o abusivo
Mancato pagamento
Richiesta delle autorità competenti

Puoi cancellare il tuo account in qualsiasi momento dalle impostazioni.

9. Modifiche ai Termini

Ci riserviamo il diritto di modificare questi Termini in qualsiasi momento. Le modifiche saranno comunicate tramite email o avviso sul sito. L'uso continuato del Servizio dopo le modifiche costituisce accettazione dei nuovi Termini.

10. Legge Applicabile e Foro Competente

I presenti Termini sono regolati dalla legge italiana. Per qualsiasi controversia sarà competente il Foro di Piacenza, salvo diversa disposizione di legge inderogabile.

1. Acceptance of Terms

By using Plumber AI ("Service"), you agree to be bound by these Terms of Service. If you do not accept these terms, do not use the Service.

The Service is provided by Tommaso Magnani, located at Via Calvi 9, Castel San Giovanni, Piacenza, Italy, email: plumberaiapp@gmail.com.

2. Description of Service

Plumber AI is a web application that provides:

AI assistance for diagnosing boiler and thermostat problems
Step-by-step guides for resolving common issues
Technical information based on device instruction manuals
Database of error codes for various boiler models

3. User Account

3.1 Registration

To use certain features of the Service, you must create an account by providing a valid email address and password.

3.2 Account Responsibility

You are responsible for:

Maintaining the confidentiality of your login credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use

4. Credit System and Payments

4.1 Credits

The Service uses a credit system:

Each message sent to the AI assistant consumes 1 credit
New users receive free credits upon registration
Additional credits can be purchased through the Service

4.2 Purchases

Payments are securely processed through Stripe
Prices are shown in Euros (EUR) and include VAT where applicable
Purchased credits do not expire
Credits are non-transferable between different accounts
Refund conditions are detailed in section 4.3

4.3 Refund Policy

Our refund policy complies with Article 16(m) of EU Directive 2011/83/EU on consumer rights.

Unused credits — You may request a full refund within 14 days of purchase, provided that none of the credits in the transaction have been used. Send your request to plumberaiapp@gmail.com including the account email and the purchase date. Refunds are processed within 7 business days to the original payment method.

Used credits — Once consumed, even partially, credits are non-refundable. By purchasing the package and starting its use, you expressly acknowledge waiver of your right of withdrawal, as provided by EU law on consumed digital content.

Technical errors — In case of double charge, system malfunction, or incorrect credit allocation, refunds are automatic and prioritized. Contact us immediately with your Stripe receipt.

Bank disputes (chargebacks) — Unfounded disputes received through banking networks will be defended by providing Stripe with evidence of service usage (access logs, consumed credits, IP address). If the outcome is unfavorable to the user, the system will automatically deduct the corresponding credits from the account.

Goodwill exceptions — We reserve the right to grant partial or full refunds outside the above cases, at our discretion, particularly for new users dissatisfied with the service within the first 48 hours of registration.

5. Acceptable Use

You agree NOT to:

Use the Service for illegal or unauthorized purposes
Attempt to circumvent the Service's security measures
Interfere with the operation of the Service
Use automated systems (bots) to access the Service
Resell or redistribute access to the Service
Provide false information during registration

6. Limitations of Liability

6.1 Informational Nature

The Service provides information for indicative and guidance purposes only. AI assistant responses:

Do NOT constitute professional technical advice
Do NOT replace the intervention of a qualified technician
May contain errors or inaccuracies
Are based on general information that may not apply to your specific case

6.2 Safety

For work involving:

Gas systems: you MUST contact qualified technicians
Electrical systems: rely on qualified personnel
Water pressure: if in doubt, contact a professional

6.3 Disclaimer

The Service is provided "AS IS" without warranties of any kind. We are not liable for:

Direct or indirect damages arising from use of the Service
Damage to persons or property caused by interventions based on information provided
Service interruptions or data loss
Inaccuracies in information provided by the AI assistant

7. Intellectual Property

All content on the Service, including text, graphics, logos, icons, and software, is owned by Plumber AI or its licensors and is protected by copyright laws.

Technical information about devices is taken from the instruction manuals of the respective manufacturers, used for informational purposes.

8. Suspension and Termination

We reserve the right to suspend or terminate your access to the Service in case of:

Violation of these Terms
Fraudulent or abusive behavior
Non-payment
Request from competent authorities

You may delete your account at any time from settings.

9. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be communicated via email or notice on the site. Continued use of the Service after changes constitutes acceptance of the new Terms.

10. Governing Law and Jurisdiction

These Terms are governed by Italian law. Any disputes shall be subject to the jurisdiction of the Court of Piacenza, unless otherwise provided by mandatory law.
